Update, October 15: Texas BOMA shared the brief with the Elevator Advisory Board and offered public comments at the Board’s October 6 meeting. TDLR and the Board acknowledged significant pushback on the new reporting form and requirements, and TDLR announced that it plans to return to the previous process. We are awaiting written clarification on what that includes and when it takes effect. Until TDLR provides it, members should continue to follow the current requirements, including reporting accidents, incidents, and Reportable Conditions, including entrapments, within 24 hours.

Texas BOMA recently submitted additional comments to the Texas Department of Licensing and Regulation (TDLR) on its review of 16 TAC Chapter 74, the rules governing elevators, escalators, and related equipment. The submission asks TDLR to bring greater clarity and consistency to how Reportable Conditions are identified and handled, while preserving the safety protections at the heart of the program. The letter from Texas BOMA and an advocacy brief with recommendations can be found below:

Texas BOMA remains supportive of Chapter 74's safety framework and will keep members updated as TDLR's review continues and new guidance is released. Questions about the filing can be directed to Bradley Elliott at belliott@bomatexas.org.
