On Friday, October 9, 2026, the Office of the Attorney General (OAG) published revised proposed rules
implementing SB 17 in the Texas Register. The new proposal follows the withdrawal of the OAG’s March
2026 proposal, which lapsed on September 27, 2026. The October rules retain the March proposal’s
core provisions and add several new ones, including a due diligence safe harbor. The rules are
proposed and not yet in effect. The public comment period runs 30 days from publication, through
Sunday, November 8, 2026.
Read the Advocacy Brief below for a summary of the re-proposed foreign ownership rules, a comparison of the March and October proposals, and the full text of the proposed rules.
